President Obama extends 9/11 national emergency

WASHINGTON, D.C. (BNO NEWS) -- President Obama on Thursday extended the national emergency declared following the September 11, 2001 terrorist attacks.

President Bush first declared the national emergency on September 14, 2001, three days after the terrorist attacks which left thousands of people dead in three American cities. The National Emergencies Act requires each national emergency to be ended or continued every year.

"Because the terrorist threat continues, the national emergency declared on September 14, 2001, and the powers and authorities adopted to deal with that emergency, must continue in effect beyond September 14, 2009. Therefore, I am continuing in effect for an additional year the national emergency the former President declared on September 14, 2001, with respect to the terrorist threat," Obama wrote to Congress.

President Obama said the terrorist threat of further attacks on the United States is continuing and remains an "immediate threat."

DOJ to judge: dump birthers' suit

The Justice Department is urging a federal court to toss out a lawsuit in which prominent birthers' attorney Orly Taitz is challenging President Barack Obama's Constitutional qualifications to be president.

In a motion filed Friday in U.S. District Court in Santa Ana, Calif., government lawyers did not directly rebut the conspiracy theory Taitz propounds that Obama was not born in Hawaii as he claims and as asserted by Hawaiian officials as well as contemporary newspaper birth notices. Instead, the federal attorneys argued that the suit is inherently flawed because such disputes can't be resolved in court and because the dozens of plaintiffs can't show they are directly injured by Obama's presence in office.

"It is clear, from the text of the Constitution, and the relevant statutory law implementing the Constitution’s textual commitments, that challenges to the qualifications of a candidate for President can, in the first instance, be presented to the voting public before the election, and, once the election is over, can be raised as objections as the electoral votes are counted in the Congress," Assistant United States Attorneys Roger West and David DeJute wrote. "Therefore, challenges such as those purportedly raised in this case are committed, under the Constitution, to the electors, and to the Legislative branch."

The birthers' suit claims that Obama is a citizen of Indonesia and "possibly still citizen of Kenya, usurping the position of the President of the United States of America and the Commander-in-Chief.”

Lieutenant Jason Freese and some other plaintiffs in the case claim they have a real injury because they are serving in the military commander by Obama, the alleged usurper. However, West and DeJute say that argument is too speculative.

"The injuries alleged by Plaintiff Freese and the other military Plaintiffs herein, are not  particularized as to them, but, rather, would be shared by all members of the military and is an inadequate basis on which to establish standing," the government lawyers wrote.

Another plaintiff in the suit, Alan Keyes, is a three-time, longshot presidential candidate who ran most recently in 2008. Yet another is Gail Lightfoot, an ultra-longshot vice presidential candidate in 2008. The DOJ argues that they were not directly aggrieved by Obama's election because they never had a mathematical chance of winning.

"The [lawsuit] does not allege, nor could it allege, that any of these Plaintiffs were even on the ballot in enough states in the year 2008 to gain the requisite 270 electoral votes to win the Presidential election," the motion states.

The Justice Department brief takes a few shots at the wackiness of the birthers, accusing them of trafficking in "innuendo" and advancing "a variety of vaguely-defined claims purportedly related to a hodgepodge of constitutional provisions, civil and criminal statutes, and the Freedom of Information Act."

Those arguments notwithstanding, the DOJ lawyers were pretty kind to the birthers and to Taitz, since the filings in the case are replete with spelling errors, among others. Taitz submitted another purported foreign birth certificate for Obama last week in a filing labeled, "Kenian Hospital Birth Certificate for Barack Obama."

The case is set for a hearing Tuesday morning before Judge David Carter. There's a strong chance the session will devolve into something of a sideshow since a couple of plaintiffs in the case are now in a dispute with Taitz and have sought to bring in a different attorney to represent them in the case.

Approaching Epidemic: Brain Damage from Mobile Phone Radiation

A collaborative team of international EMF activists has released a report detailing eleven design flaws of the 13-country, Telecom-funded Interphone study.

The exposé discusses research on cell phones and brain tumors, concluding that:

  • There is a risk of brain tumors from cell phone use
  • Telecom funded studies underestimate the risk of brain tumors
  • Children have larger risks than adults for brain tumors

The Interphone study, begun in 1999, was intended to determine the risks of brain tumors, but its full publication has been held up for years. Components of this study published to date reveal what the authors call a ‘systemic-skew’, greatly underestimating brain tumor risk.

The design flaws include categorizing subjects who used portable phones (which emit the same microwave radiation as cell phones,) as ‘unexposed’; exclusion of many types of brain tumors; exclusion of people who had died, or were too ill to be interviewed as a consequence of their brain tumor; and exclusion of children and young adults, who are more vulnerable.

Ronald B. Herberman, MD, Director Emeritus of the University of Pittsburgh Cancer Institute has stated,

“Based on substantial evidence, especially from industry-independent studies that long term exposure to radiofrequency radiation may lead to increased risk for brain tumors, I issued a precautionary advisory last year to faculty and staff of the University of Pittsburgh Cancer Institute.

Since then, my particular concern about exposure of children to radiofrequency has been supported by a report from Dr. Lennart Hardell. Some of my scientific colleagues have expressed skepticism about the reported biological effects, especially DNA0A damage by radiofequency radiation, because of the absence of a demonstrated underlying molecular mechanism.

However, based on the precautionary principle, I believe it is more prudent to take seriously the reports by multiple investigators that radiofrequency can damage DNA and increase the risk for brain tumors, and for industry-independent agencies to provide needed funding for detailed research to ascertain the molecular basis for such effects.”

Lloyd Morgan, lead author and member of the Bioelectromagnetics Society says,

“Exposure to cell phone radiation is the largest human health experiment ever undertaken, without informed consent, and has some 4 billion participants enrolled.

Science has shown increased risk of brain tumors from use of cell phones, as well as increased risk of eye cancer, salivary gland tumors, testicular cancer, non-Hodgkin's lymphoma and leukemia.

The public must be informed.”

A BILL

To authorize the Secretary of Health and Human Services to carry out a demonstration program to test the feasibility of using the Nation's elementary and secondary schools as influenza vaccination centers.

    Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

    This Act may be cited as the `No Child Left Unimmunized Against Influenza Act of 2009'.

SEC. 2. FINDINGS.

    The Congress finds as follows:

      (1) The influenza is a contagious respiratory illness caused by influenza viruses. The best way to prevent the influenza is by getting a influenza vaccination each year.

      (2) Every year in the United States, on average, more than 200,000 people are hospitalized from influenza-related complications, and about 36,000 people die from influenza-related causes.

      (3) The Centers for Disease Control and Prevention (CDC) Advisory Committee on Immunization Practices recommends routine influenza vaccination for all children aged 6 months through 18 years with influenza vaccine, effective July 1, 2008.

      (4) Children 2 to 17 years of age are twice as likely to get influenza as adults, including the elderly.

      (5) School-aged children are the population group most responsible for transmission of contagious respiratory viruses, including influenza.

      (6) The elderly and young children are the most vulnerable population to severe illness from influenza due to weaker immune response to vaccination. Experts have recognized that the best way to protect the elderly from influenza may be to vaccinate children.

      (7) School-based vaccination programs are effective and cost-saving ways to vaccinate children while reducing transmission and infection rates to the larger community and at the same time reducing rates of school absenteeism due to influenza.

      (8) Increased focus on providing influenza vaccine to children targeted for immunization will also help efforts to build a sound foundation for future vaccination efforts.

      (9) School-based vaccination programs also potentially represent the most feasible mechanism for community-based pandemic vaccination.

      (10) Increased participation in annual influenza vaccination programs builds the infrastructure necessary for pandemic vaccination.

      (11) School-based programs will investigate the feasibility of conducting mass immunization clinics and build partnerships with local public health teams, in the event of a public health emergency.

SEC. 3. DEMONSTRATION PROGRAM USING ELEMENTARY AND SECONDARY SCHOOLS AS INFLUENZA VACCINATION CENTERS.

    (a) In General- The Secretary of Health and Human Services, in consultation with the Secretary of Education and the Secretary of Labor, shall carry out a multistate demonstration program designed to test the feasibility of using the Nation's elementary schools and secondary schools as influenza vaccination centers in coordination with school nurses, school health care programs, local health departments, community health care providers, State insurance agencies, and private insurers.

    (b) Program Description-

      (1) VACCINATION-

        (A) CHILDREN COVERED BY OTHER FEDERAL PROGRAMS- For children who are eligible under other federally funded programs for payment of the costs of purchasing and administering the influenza vaccine, the Secretary shall not use the demonstration program under this section to supplant payment of such costs.

        (B) CHILDREN COVERED BY PRIVATE HEALTH INSURANCE- For children who have private insurance, the Secretary shall work with the Secretary of Labor, State insurance agencies, and private insurers to ensure that such children have coverage for all reasonable and customary expenses, including the costs of purchasing and administering the vaccine, incurred when influenza vaccine is administered outside of the physician's office in a school or other related setting.

        (C) OTHER CHILDREN- To the extent to which payment of the costs of purchasing and administering the influenza vaccine for children is not covered through other federally funded programs or through private insurance, the Secretary may pay such costs through the demonstration program under this section.

      (2) ACIP RECOMMENDATIONS- The demonstration program shall be designed to administer vaccines consistent with the recommendations of the Advisory Committee on Immunization Practices for the annual vaccination of all children aged 5 years through 19 years.

      (3) LOCATIONS-

        (A) SELECTION- The Secretary, in consultation with the Secretary of Education, shall select the elementary schools and secondary schools to participate in the demonstration program.

        (B) SELECTION CRITERIA- The schools selected under subparagraph (A) shall include elementary schools and secondary schools--

          (i) located in at least 10 metropolitan regions in at least 10 States and serving primarily low-income public school student populations; and

          (ii) located in at least 5 major areas in at least 5 States served by rural school districts.

      (4) VOLUNTARY PARTICIPATION- Participation in the demonstration program by a school or an individual shall be voluntary.

      (5) DURATION- The demonstration program shall be conducted for the 2010-2011 and 2011-2012 influenza seasons.

      (6) CHOICE OF VACCINE- The demonstration program shall not restrict the discretion of a health care provider to administer any influenza vaccine approved by the Food and Drug Administration for use in pediatric populations.

    (c) Report- Not later than 90 days following the completion of the demonstration program under this section, the Secretary shall submit to the Committees on Education and Labor, Energy and Commerce, and Appropriations of the House of Representatives and to the Committees on Health, Education, Labor, and Pensions and Appropriations of the Senate a report on the results of the program. The report shall include--

      (1) an assessment of the influenza vaccination rates of school-aged children in localities where the demonstration program is implemented, compared to the national average influenza vaccination rates for school-aged children, including whether school-based vaccination assists in achieving the recommendations of the Advisory Committee on Immunization Practices for annual influenza vaccination of all children aged 6 months to 18 years;

      (2) an assessment of the utility of employing elementary schools and secondary schools as a part of a multi-state, community-based pandemic response program that is consistent with existing Federal and State pandemic response plans;

      (3) an assessment of the feasibility of using existing Federal and private insurance funding in establishing a multi-state, school-based vaccination program for seasonal influenza vaccination;

      (4) an assessment of the number of education days gained by students as a result of seasonal vaccinations based on absenteeism rates;

      (5) a determination of whether the demonstration program under this section--

        (A) was successful; and

        (B) was implemented for sufficient time for gathering enough valid data; and

      (6) a recommendation on whether the demonstration program under this section should be continued, expanded, or terminated.

    (d) Definitions- In this section:

      (1) The terms `elementary school' and `secondary school' have the meanings given such terms in section 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7801).

      (2) The term `low-income' means at or below 200 percent of the income level specified in the most recent applicable version of the Department of Health and Human Services Poverty Guidelines per person in a family unit.

      (3) Except as otherwise specified, the term `Secretary' means the Secretary of Health and Human Services.

    (e) Authorization of Appropriations- To carry out this section, there is authorized to be appropriated $5,000,000 for each of fiscal years 2010 through 2012.

“Stop the 9-11 cover-up"

The push for another investigation into the 9/11 attacks grows larger with each passing year, particularly today when the US is commemorating the eighth anniversary of the 9/11 attacks, which claimed almost three thousand lives.

Manuel Badillo’s uncle died when the Twin Towers came down. He believes the US leaders had prior knowledge of the impending attacks but consciously failed to act.

He asks, “Why was there no justice yet? Why is there no accountability?”

Badillo is among roughly 80,000 New Yorkers petitioning for a new, impartial, probe to answer the questions many believe state and federal officials are failing to address.

Manuel Badillo says, "The majority of family members do not believe the story. First responders do not believe what they were told by the government. All of this turned out to be lies, what we have been told. 60% of the commissioners do not believe the story they received."

Critics say the 9/11 Commission Report, presented as the official version of events, failed to hold a single individual accountable for the numerous warnings leading up to, on and after September 11.

The NYC Coalition of Accountability Now (CAN) is an organization that is focused on getting a referendum during this November’s mayoral election, to allow New Yorkers the chance to vote for a new 9/11 investigation.

“It’s absolutely essential for the world, for the well-being of the world, that we understand why 9/11 occurred; who was behind it,” says Ted Walter, executive director of CAN. “Because if we have a false understanding, we’re going to be basing policies on that false understanding.”

Pressure’s even coming from the west coast – Hollywood actor Charlie Sheen has written a 15-page public letter to the president calling for another 9/11 inquiry.

But a move like Sheen’s can be quite a gamble in the domain of American public opinion. Just ask Van Jones, Obama’s former ‘green jobs tsar’. He stepped down because of hysteria over his support for and association with 9/11 truth-finders.

“Van Jones should have stuck to his feelings and to his democratic actions that he took, and his intuition, because the majority of Americans, the majority of New Yorkers, all the polls show it, know the government did not tell us the entire story about 9/11,” says Manuel Badillo.

Eight years ago all New Yorkers were standing shoulder-to-shoulder on the day nearly three thousand people perished from attacks. Now the citizens are standing on one side, police officers on the other, and many are asking for accountability, a demand from which these Americans refuse to back off.
